Private Company
A private limited company is one which can be formed by two or more individuals and restricts the rights of its members to transfer the shares and one which cannot legally accept deposits from the public.
Public Company
A public company may be formed by seven or more individuals, by subscribing their names to a constitutional document called Memorandum and Articles of Association. Regulatory compliance requirements for public companies are more stringent than for private limited companies.
One person company
A One Person Company as the name suggests can be formed by a single individual, who shall nominate another individual to become the member of this Company, in the event of the first individual’s death or incapacity. Compliance requirements for OPC’s are few and less cumbersome.
Licensed companies or not-for-profit companies (section 8)
These are associations, which are registered as Limited Liability Companies, mainly formed for the promotion of commerce, art, science, sports, education, research, social welfare, religion, charity, environmental protection, and such other social and charitable causes. These are basically Companies, which are specially licensed to operate only to promote their objectives and prohibit distribution of surplus or profits, to its members as dividends.
Producer companies
Producer Companies are special entities, which are registered for activities such as farm produce, horticulture, floriculture, handloom, handicraft and other cottage industry products and associated activities for promotion of such products. These Companies are regulated by the Companies Act, 2013 and are similar to Private Limited Companies, which have limited liability.
